Legal process....

Well we received an email from Sally stating that Aby has received everything and started the process.... YAYYYYY

Now we just wait for DNA authorization, get into Family court and get the DNA test and Social workers interveiw done.(mini HomeStudy for Bmom). After those things are done we will  get results of the DNA test and exit FC. Right now PA (preapproval is taking 60 days.... and trust me they use the FULL 60 days too....... it just dont make sense 6 months ago it only took them 30 days. and even shorter before that. So hopefully we will be in PGN(Guatemala courts) by the middle to end of Oct. Cases are running 8-12 weeks in court, but some take much longer for some unknown reason. I know the Guatemala system shuts down around Christmas, and that could delay somewhat. But are still keeping a positive attitude about the length we will be in. Steve keeps saying as long as Zackary is home before his 1st B-day he will be happy.

When we get the DNA authorization we will let everyone know.

Update on POA

ok well we got the POA back on saturday, as soon as i got home i rushed to fedex to get it mailed to Aby. It was sent off 7/28 and it will arrive on Wed. then it takes 15 days to have it translated and registered. then everything can get moving.... YAYYYYY!!!!!!! Will let you know when we get DNA authorization and when the test is done....

Our POA

Well we have gotten the new POA all the way to Chicago to find out the Authenicating Officer has been out of the Office most of the week  Cry So our courier that we use said she talked to his boss and he promised that our POA would be done TODAY and she could pick it up..... Problem she don't work on friday's.......But she sent me an e-mail saying she would drive to Chicago to pick it up for us.... (she is the sweetest, if you ever need a courier just use There's Always Hope) Hopefully she gets it in the mail today and we get it tomorrow... then we can take to  FED EX and have it shipped overnight so we can get this ball rolling.... We want our son HOME!!!! It takes 15 days after receiving the POA to have it register in Guatemala. so we are looking at MID AUGUST before we can even enter Family Court and get DNA done  Cry then after DNA is done we are still looking at a 60 day wait for PA(pre-Approval) from the Embassy stating they will grant us a visa to bring him home......  We should get more photo's and medical mid August (hopefully) Can I just go to sleep and someone wake me when its time to go to Guatemala  LOL

The POA

Well after we received the referral we received the POA(power of attorney) about 2 days later, we went had it notarized and Steve took it down to SoS office (Secretary of State) to have it certified. And guess what......... the notary fudged it up.... LIKE ALWAYS..... So the lady at the SoS offered to re-notarize it and Steve agreed, only to find out she hand wrote on it.... well we all know that wont due..... So we got another one ready and started all over with it........ The day we was going to take it to SoS office we received another email from Agency, Stating "Heard from Aby tonight we are going to have to redo you POA, not using that attorney. We are getting you a new one."  OK first thing RED flags went off... LOL I sent an email asking WHY??? Sally said it was because this new attorney is FASTER.... ok well I'M OK WITH FASTER!!!!!!  LOL  anything to get Zack home quicker!!!!

Can't wait till we get an update. which will include medical reports and more pics..... and see how much he has grown!!!!! We can't wait to see him on our visit trip we are planning. Not exactly sure of the dates yet, but when we know for sure i'll post it here.

OUR SON!!!!

Well I had to leave for an out of town trip for my job, and wouldn't ya know that when it happened!!!!!!!!!

Steve was home by himself, and received the referral. He tried and tried to call me on my cell for like 4 hrs. But being at the lake i wasn't getting a very good connection. So i didn't know anything until this morning!!!!! and Steve had sent me 2 pics of Zackary!!!! awwwwww

He told Sally we would contact her on Friday, well he meant me!! LOL As soon as I got home I called Steve and he was telling me everything!!!! then i checked the computer!!!!!!! OHHHH MYYYY he is just beautiful!!!!!!!!!!

WE HAVE OUR SON REFERRAL!!!!!!!!!!!!!!!

News and waiting on Referral

 As you can tell we have chosen a name, our son will be named Zackary Steven. This was a name Steve had come up with all on his own!!! And I loved it!!!!

Well we contacted our agency last night and Sally responded with "She heard from the Cordinator that a baby boy may be referred soon!!!!

Yay!!!! com'on phone ring!!!!!

This is so nice because we have so many birthdays in July, and as you all know Steve's is the 24th, my brothers is 27th and Jenn's(SIL)is 30th. I also believe Laura and Tim(SIL's sister and hubby) is also towards the end of July. So this will be perfect!!!!!Wink

Waiting on our Referral

I emailed our Head Director Sergey to ask him about what time frames looked like and he responded quickly with this:
"You are the next on the list for a newborn baby boy, there were 3 babies in the last 2 weeks. 2 girls and 1 boy. Which is unusual. I believe your referral will be very soon" Wink

Based on time frames right now. It is taking anywhere from 6 to 12 months to complete an adoption from referral. Frown
There are many steps along the way.

Once you receive your referral, you have to sign your POA, have it notarized and have Certifacation and Authenication put on it. Then it is sent to be registered in Guatemala.

They fill out papers at the US Embassy to request authorization for DNA. This can take from 2 weeks up to 6 weeks or more to get.
Usually at the same time you are submitted to Family court, they look over your dossier and do an interveiw and a mini homestudy of the birth mother. DNA is taken from both her and the baby to ensure that she is the bio mother. At that time the birth mother signs off on the adoption for the 1st time. (She has to sign off 4 different times through out this process.)
DNA usually comes back in about 1 to 2 weeks with either a MATCH or DENIAL. If it is a match your agency will contact you and you will recieve results in the mail, along with a picture of the Bmom and baby together. You then start counting from the day you received your results in the mail as the US Embassy usually logs the results within a day or two from that. Then it is currently taking up to 60 days to get your PA (pre-approval) which is the US Embassy saying that when the adoption is final you will receive a visa for the baby.

Family Court is running about 30 to 45 days right now, depending on how soon the Bmom can come in for the interview.
Once you receive you PA then its on to PGN(which is the same as the Attorney General)times in PGN can vary greatly. Right now some are getting out in 4 weeks and some have been in for over a YEAR
there is NO rhyme or reason to it, there is no basic set of guidelines and the rules seem to change at a whim.
Once you have been approved through PGN, then your attorney applies for the new BC and passport. Once those are received then he/she submits paper work to US Embassy once again to be issued a PINK SLIP(your VISA appointment for the baby)
these have been running about 30 daysd out from submission for pink, although I have seen some that was only 2 weeks out from submission to pick up date.
